Alito and the death penalty
Tomorrow's headlines say "Alito Breaks With Conservatives". But hold on. He merely refused to overturn a decision staying an execution.
First of all, as a devout Catholic, Alito is no doubt sensitive to church doctrine which is opposed to the death penalty. Second, the issue was procedural and, even though the right wing justices ignore the fact, the standard for a stay revolves around the concept of "irreparable injury' and no injury is more irreparable than the death penalty. Although the death penalty barely came up in his confirmation hearing, his prior record is consistent with today's decision:
